SwinnockApps (“we,” “us,” or “our”) respects the intellectual property rights of others and expects users of our App (“App”) to do the same. This Copyright Policy outlines our position regarding copyright protection, user-generated content, and the process for reporting and removing infringing material.

1. Ownership of Our Software

The App, including but not limited to its software, code, design, logos, content, and all associated intellectual property, is owned and copyrighted by SwinnockApps under UK copyright law. No part of the App may be copied, modified, distributed, or reproduced without our express written permission, except as permitted by law.

2. User-Generated Content

Users may have the option to create and publish their own musical notation within the App. By submitting content to the App, users agree to the following terms:

  • Original Content: You must only upload, create, or publish content that you have the legal right to share. This means the content must either be your original work or content that you have permission to use from the copyright owner.
  • Public Liability: If you choose to publish your musical notation and make it publicly available, you do so at your own liability. You are responsible for ensuring that your content does not infringe the copyright of any third party.

We do not review user-generated content for copyright compliance. However, we reserve the right to remove or disable access to any content that we believe violates this policy.

3. Copyright Infringement and Removal Process

If you are a copyright owner or an authorised agent thereof, and you believe that any user-generated content on our App infringes your copyright, you may submit a written notice to request its removal or disablement. To file a copyright infringement claim, please follow the procedure below.

a) How to File a Copyright Infringement Notice
To notify us of alleged copyright infringement, please provide the following information:

  1. Your Contact Information: Full name, email address, phone number, and postal address.
  2. Description of the Copyrighted Work: Identify the copyrighted work you claim has been infringed.
  3. Location of the Infringing Material: Provide the URL or sufficient information to locate the infringing material within the App.
  4. Proof of Ownership: Evidence that you are the copyright owner or authorised to act on behalf of the owner of the copyrighted work.
  5. Statement of Good Faith: A statement that you have a good faith belief that the use of the copyrighted material is not authorised by the copyright owner, their agent, or the law.
  6. Declaration of Accuracy: A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner’s behalf.
  7. Signature: An electronic or physical signature of the copyright owner or authorised representative.

b) What Happens Next?
Upon receiving a valid copyright infringement notice, we will:

  • Review the claim.
  • Remove or disable access to the alleged infringing content if appropriate.
  • Notify the user who submitted the content of the removal and provide them with an opportunity to respond.

4. Counter-Notice by User

If you believe that the material removed or disabled due to a copyright infringement claim was mistakenly removed, you may file a counter-notice with us. The counter-notice must include the following:

  1. Your Contact Information: Full name, email address, phone number, and postal address.
  2. Identification of Removed Content: A description of the content that was removed and the location where it appeared before removal.
  3. Statement of Good Faith: A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification.
  4. Consent to Jurisdiction: A statement consenting to the jurisdiction of the courts of the UK and agreeing to accept service of process from the person who filed the original claim or their agent.
  5. Signature: An electronic or physical signature of the user filing the counter-notice.

You may submit the counter-notice to the same contact information provided above. If a valid counter-notice is received, we may restore the content unless the copyright owner files a court action seeking to prevent the user from continuing the infringing activity.

5. Termination of Repeat Infringers

In accordance with applicable laws, we may terminate user accounts that are determined to be repeat infringers of copyright or other intellectual property rights.

6. Copyright in the United Kingdom

This App and all its contents are protected under UK copyright law. All rights not expressly granted to users remain with SwinnockApps. Users should understand that unauthorised use of our software or any of its content is a violation of copyright law and may result in legal consequences.

7. Changes to This Copyright Policy

We reserve the right to update or modify this Copyright Policy at any time. Any changes will be posted on this page, and if the changes are significant, we will notify you via email or within the App.
