SwinnockApps (“we,” “us,” or “our”) respects the intellectual property rights of others and expects users of our App (“App”) to do the same. This Copyright Policy outlines our position regarding copyright protection, user-generated content, and the process for reporting and removing infringing material.

1. Ownership of Our Software

The App, including but not limited to its software, code, design, logos, content, and all associated intellectual property, is owned and copyrighted by SwinnockApps under UK copyright law. No part of the App may be copied, modified, distributed, or reproduced without our express written permission, except as permitted by law.

2. User-Generated Content

Users may have the option to create and publish their own musical notation within the App. By submitting content to the App, users agree to the following terms:

  • Original Content: You must only upload, create, or publish content that you have the legal right to share. This means the content must either be your original work or content that you have permission to use from the copyright owner.
  • Public Liability: If you choose to publish your musical notation and make it publicly available, you do so at your own liability. You are responsible for ensuring that your content does not infringe the copyright of any third party.

We do not review user-generated content for copyright compliance. However, we reserve the right to remove or disable access to any content that we believe violates this policy.

3. Copyright Infringement and Removal Process

a) How to File a Copyright Infringement Notice

If you are a copyright owner or an authorised agent thereof, and you believe that any user-generated content on our App infringes your copyright, please submit a written notice with the following:

  • Your Contact Information: Full name, email address, phone number, and postal address.
  • Description of the Copyrighted Work: Identify the copyrighted work you claim has been infringed.
  • Location of the Infringing Material: Provide the URL or enough detail to locate the content.
  • Proof of Ownership: Evidence that you are the copyright owner or authorised representative.
  • Statement of Good Faith: Statement that the use is not authorised by the copyright owner, agent, or the law.
  • Declaration of Accuracy: Statement that the information is accurate and made under penalty of perjury.
  • Signature: Electronic or physical signature.

b) What Happens Next?

Upon receiving a valid notice, we will:

  • Review the claim.
  • Remove or disable access to the alleged infringing content if appropriate.
  • Notify the user who submitted the content and provide them an opportunity to respond.

4. Counter-Notice by User

If you believe the removed material was mistakenly taken down, you may file a counter-notice including:

  • Your Contact Information: Full name, email, phone, and address.
  • Identification of Removed Content: Description and location before removal.
  • Statement of Good Faith: Statement under penalty of perjury that it was removed in error.
  • Consent to Jurisdiction: Agreement to UK court jurisdiction and to accept legal process from the original claimant.
  • Signature: Electronic or physical signature.

Submit the counter-notice to the same contact email above. If valid, we may restore the content unless a legal claim is filed by the copyright owner.

5. Termination of Repeat Infringers

In accordance with applicable laws, we may terminate user accounts that are determined to be repeat infringers of copyright or other intellectual property rights.

6. Copyright in the United Kingdom

This App and all its contents are protected under UK copyright law. All rights not expressly granted remain with SwinnockApps. Unauthorised use may result in legal action.

7. Changes to This Copyright Policy

We reserve the right to update this policy at any time. Changes will be posted on this page, and for significant updates, we may notify you via email or within the App.
